What is Required to Modify a Court Order?
The process of modifying a court order for same-sex couples is similar to the process that heterosexual couples must follow. Essentially, the court is looking for a valid reason to alter the orders and one party’s individual preferences typically does not constitute a valid reason.
The court must see proof of the following before modifying an order:
-
A material and substantial change in circumstances
-
That the change would be in the child’s best interests (child custody orders only)
Proving one or both of these things can be difficult, but we have experience with successfully showing the court that an order modification is necessary. The two most common examples of a change in circumstances are the loss of a job or a serious health issue. There are, however, other events that can warrant a modification.
